SportsMetricsTerms of Service

These Terms govern your use of the SportsMetrics mobile app and the website sportsmetrics.pro (the "Service"), provided by DIX Company ("we", "us"). By using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live if higher, and legally able to enter into this agreement. You are responsible for making sure your use of the Service is lawful where you are.
2. Your account
You sign in with a Google or Apple account. You are responsible for activity under your account and for keeping your sign-in credentials secure. Tell us promptly if you suspect unauthorised use. One person may not hold multiple accounts to abuse free offers.
3. Informational use only
SportsMetrics provides sports analysis and statistical predictions for information and entertainment. It is not betting, financial or professional advice. Predictions are estimates based on models and third-party data, may be wrong, and do not guarantee any outcome. We do not accept, place or facilitate bets, and we are not a gambling operator. Any decision you make using the Service is your own responsibility and risk.
4. Tokens and purchases
- Tokens are a virtual, in-app credit used to unlock analyses. They have no cash value and cannot be exchanged for money, transferred or sold.
- You receive one free daily pick, subject to the rules shown in the app. Unused free picks do not accumulate.
- Token packs are purchased through the Apple App Store or Google Play and are subject to their payment terms.
- Unlocking an analysis spends tokens immediately and cannot be reversed once the content is revealed.
- Except where required by law or the store's policy, purchased tokens are non-refundable. Refund requests for store purchases are handled by Apple or Google under their policies. If a technical error causes a loss of tokens, contact us and we will correct it.
- We may change token prices, pack sizes and the cost of unlocks at any time, without affecting tokens you already hold.
5. Acceptable use
You agree not to: scrape, copy or resell the Service's data or predictions; reverse engineer the app; circumvent token, rate-limit or security controls; interfere with or overload the Service; use bots or automation; or use the Service for unlawful purposes.
6. Intellectual property
The Service, including its software, models, design and content, belongs to us or our licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use. Third-party sports data and trademarks belong to their respective owners, and we are not affiliated with any league, team or bookmaker.
7. Third-party data and services
The Service relies on third parties for sports data, authentication and payments. We do not control them and are not responsible for their accuracy or availability. Data may be delayed, incomplete or incorrect.
8. Availability and changes
We may modify, suspend or discontinue any part of the Service at any time. We try to keep it running but do not promise uninterrupted or error-free operation.
9. Termination
You may stop using the Service and request account deletion at any time by emailing support@sportsmetrics.pro. We may suspend or terminate accounts that breach these Terms or put the Service or others at risk. Remaining tokens are forfeited on termination for breach.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or wagers arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, including consumer rights where you live.
12. Governing law
These Terms are governed by the laws of Serbia, without regard to conflict-of-law rules. Courts of that jurisdiction have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring a claim where you live.
13. Changes to these Terms
We may update these Terms. The "Last updated" date will change, and continued use after changes means you accept them. For material changes we will give notice in the app or by email where appropriate.
